The content, digital badges, and other information on the Service are not intended to serve as the basis for any investment decision. Decisions regarding cryptocurrency or digital assets should be made at your own discretion and risk. 2. Not Securities or Financial Instruments

Digital badges (compressed NFTs/cNFTs) issued by the Service do not constitute securities, financial instruments, investment contracts, derivatives, or any other regulated financial products in any jurisdiction. Digital badges function solely as proof of community participation, achievement records, or digital collectibles.

The Service expressly disclaims any characterization of digital badges as:

• Securities or investment contracts under the U.S. Securities Act of 1933 or the Howey Test;
• Financial instruments under the Markets in Financial Instruments Directive (MiFID II);
• Crypto-assets subject to the Markets in Crypto-Assets Regulation (MiCA);
• Any form of regulated financial product under the laws of any other jurisdiction.

3. No Expectation of Profit

Digital badges are acquired solely for their utility, collectible, or commemorative value. By using the Service, you acknowledge and agree that:

• You have no expectation of profit, income, capital appreciation, or financial return from acquiring, holding, or using digital badges;
• The value of digital badges is derived solely from their utility as collectibles, community participation tokens, or achievement records;
• Any referral commissions or bonus points are operational incentives for platform engagement and do not represent investment returns, dividends, or profit-sharing;
• The Service does not pool funds, manage assets, or engage in any activity that would create a common enterprise with Users.

4. Non-Custodial Service

The Service operates on a strictly non-custodial basis. At no point does the Service hold, control, manage, or have access to your private keys, seed phrases, wallet credentials, or digital assets. Wallets provisioned through the Service are managed exclusively by third-party wallet infrastructure providers (e.g., Privy), and the User retains sole control over their wallet at all times.

The Service cannot:

• Access, freeze, seize, or transfer your digital assets;
• Recover lost or stolen private keys or seed phrases;
• Reverse, cancel, or modify blockchain transactions;
• Restore access to wallets for which credentials have been lost.

5. User Responsibility for Wallet Security

You are solely and exclusively responsible for the security and management of your wallet, private keys, and all associated credentials. This includes, without limitation:

• Maintaining secure backups of your private keys and seed phrases;
• Using strong, unique passwords and enabling all available security features;
• Verifying all transaction details before signing or approving;
• Protecting your devices from malware, phishing, and unauthorized access;
• Understanding that all blockchain transactions are final and irreversible.

The Service disclaims all liability for any loss of digital assets, digital badges, or cryptocurrency resulting from compromised, lost, or stolen wallet credentials.

6. Risk Disclosure

Cryptocurrency and blockchain technology carry inherent and significant risks, including but not limited to:

• Market Volatility: The value of cryptocurrency and digital assets can fluctuate dramatically and may decrease to zero;
• Blockchain Risk: Network congestion, outages, forks, or protocol changes may affect transaction processing and asset accessibility;
• Smart Contract Risk: Smart contracts may contain undiscovered vulnerabilities, bugs, or exploits;
• Regulatory Risk: The regulatory landscape for digital assets varies by jurisdiction and is subject to rapid change, which may restrict or prohibit the use, transfer, or holding of digital badges;
• Technology Risk: Wallet software, browser extensions, and third-party integrations may malfunction, be discontinued, or be compromised;
• Cybersecurity Risk: Despite reasonable security measures, no system is immune to cyberattacks, hacking incidents, or unauthorized access;
• Permanent Loss: If you lose access to your wallet, your digital badges and any associated digital assets may be permanently and irrecoverably lost;
• Tax Implications: The acquisition, holding, and disposal of digital assets may have tax implications in your jurisdiction. You are solely responsible for determining and fulfilling your tax obligations.

7. No Guarantee of Value

The Service does not guarantee the monetary value, future value, or liquidity of digital badges. The market value of digital badges may fluctuate and could potentially reach zero. Past performance does not guarantee future results. The Service makes no representations about the future availability of any marketplace or secondary market for digital badges.

8. Third-Party Services

The Service may integrate with third-party services such as wallet providers, blockchain networks, and marketplaces. The Service is not responsible for the availability, accuracy, security, or performance of these third-party services. Your use of third-party services is subject to their respective terms and conditions.

9. Geographic Restrictions

The Service is not directed at or intended for residents of any specific country or region. Users are responsible for complying with applicable laws in their jurisdiction of residence. Access from jurisdictions where the use of the Service is prohibited is undertaken at the user's own risk. The Service reserves the right to restrict access from any jurisdiction at any time without prior notice.

THE SERVICE AND ALL CONTENT, DIGITAL BADGES, AND FUNCTIONALITY ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. THE SERVICE EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

The Service does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the Service will be accurate or reliable; (c) any errors in the Service will be corrected; or (d) the Service will meet your specific requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ITS OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, DIGITAL ASSETS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

In no event shall the aggregate liability of the Service exceed the total amount of fees actually paid by you to the Service in the twelve (12) months preceding the claim, or one hundred US dollars (USD $100), whichever is less.
