These Terms of Service ("Terms") govern your use of all services provided by Mint Partys ("the Service"), operated by a company incorporated in the British Virgin Islands (BVI). By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Service.
"Digital Badge" refers to blockchain-based digital certificates (compressed NFTs/cNFTs) issued on the Service. These are utility-only digital collectibles that serve as proof of participation, achievement, or community membership. "User" refers to any individual or entity that registers and uses the Service. "Wallet" refers to the blockchain wallet associated with a User's account, whether auto-provisioned by the Service or externally connected.
Users must register through the methods prescribed by the Service. You are responsible for maintaining accurate and up-to-date registration information. Account management is your responsibility, and accounts may not be transferred or lent to third parties.
Users may acquire digital badges through free distribution or paid acquisition. Soulbound (non-transferable) badges cannot be transferred or sold to other users after acquisition. Cryptocurrency (SOL, etc.) used for paid badge acquisitions is non-refundable after transaction completion. Digital badges are acquired solely for their utility, collectible, or commemorative value. No digital badge is offered, sold, or distributed with any expectation of profit, return on investment, or financial gain.
The Service operates on a non-custodial basis. The Service does not hold, manage, or have access to your private keys, seed phrases, or wallet credentials at any time. Wallets provisioned through the Service are controlled exclusively by the User through third-party wallet infrastructure (e.g., Privy). The Service has no ability to recover, reset, or access your wallet or its contents.

The Service shall bear no liability whatsoever for any loss of digital assets, digital badges, or cryptocurrency resulting from the User's failure to secure their wallet credentials. Lost private keys cannot be recovered by the Service or any third party.
Digital badges available on the Service are utility-only digital collectibles. They are not securities, investment contracts, financial instruments, derivatives, or any form of regulated financial product under the laws of any jurisdiction.

Users must not engage in: unauthorized access or service disruption, registration with false information, infringement of the Service's intellectual property rights, activities violating laws or public order, market manipulation or wash trading, use of the Service for money laundering or terrorist financing, or any other activities deemed inappropriate by the Service.
The Service may change, suspend, or terminate its services without prior notice. The Service assumes no liability for any damages arising from such changes.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
To the maximum extent permitted by applicable law, the Service and its operators, directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, data, digital assets, goodwill, or other intangible losses, arising from or related to:
In no event shall the aggregate liability of the Service exceed the total amount of fees actually paid by you to the Service in the twelve (12) months preceding the claim, or one hundred US dollars (USD $100), whichever is less.
Intellectual property rights related to the Service belong to the Service or its licensors. Users have personal usage rights for acquired digital badges, but commercial use requires separate authorization.
The Service may modify these Terms as necessary. Modified Terms take effect upon publication on the Service. Continued use of the Service after publication constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the British Virgin Islands (BVI). Any disputes arising from or relating to the Service shall be subject to the exclusive jurisdiction of the courts of the BVI or an arbitration body designated by the Service.
The Service is not directed at or intended for residents of any specific country or region. Users are responsible for using the Service in compliance with the laws applicable in their country of residence. The Service reserves the right to prohibit or restrict access in any jurisdiction where the use of the Service would be unlawful. The Service and digital badges do not constitute securities, financial instruments, or investment contracts, and are not offered for investment purposes.
You agree to indemnify, defend, and hold harmless the Service and its operators, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
